To the Design Trade Only

Ann Parks Fine Art is available only to re-sellers within the design trade.  As a wholesaler, we do not sell directly to consumers.  You agree when you apply for and create an account that you are a re-seller and to provide us with a copy of your resale certificate upon request. 

Copyright

All artwork, images, text, graphics, logos and content on Ann Parks Fine Art is the property of Ann Parks Fine Art or its content suppliers and is copyrighted under United States and International Copyright Laws.  The purchase of any product does not grant or provide the purchaser with any re-print permissions, copyright interest or other intellectual property right in the art product.  Use of art of Ann Parks Fine Art, images, logos and content as screensavers, print materials such as postcards, greeting cards, virtual postcards, digital pictures is expressly forbidden as this is a violation of copyright.  All content on our site that is not the property of Ann Parks Fine Art is used with permission. 

All artwork, images and content on Ann Parks Fine Art is copyrighted and may not be used for marketing purposes, for website imagery, for retail or wholesale products or to create derivative works of art.

No permission is granted to you to print, copy, reproduce, distribute, license, transfer, sell, transmit, upload, store, display in public, alter, modify or create derivative works of the art, content or website.  Your use of the website and the art is subject to the restrictions in these terms and conditions. 

License of Use and Website Access

Ann Parks Fine Art website design is for e-commerce B2B use specifically within the interior architectural design trade.  These terms and conditions govern your use of this website.  By using this website, you accept these terms and conditions in full and agree to be bound by them and all applicable laws and regulations.  Any use of this site or it's art and content which not authorized or is based on a false trade account application is not allowed and immediately terminates the license granted. 

You may not use this website or it's content for any purposes related to marketing.  You may not conduct any systemic or automatic data collection activities including but not limited to scraping or data mining.  You may not use this website in any way that causes or may cause damage to the website, disrupts the website or impairs function of the website.

Upon trade account application, Ann Parks Fine Art grants immediate but tentative access to our site until your business account data has been confirmed.  Couture-Arts reserves the right to terminate and disable to your account, user ID and password at our sole discretion without notice. 

Privacy Policy

We will only use your information to process and communicate regarding orders, shipping, to provide answers to questions or general information related to your account and if you have opted in to our newsletters we will email you information on new art or products.  We do not sell your information. 

Electronic Communications

You consent to receive communications from Ann Parks Fine Art by email.  You agree that all agreements, notices, disclosures and other communications that we provide to you by email satisfy any legal requirement that such communications be in writing.

Your Account

If you use the Ann Parks Fine Art website, you are responsible for maintaining the confidentiality of your account and your password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.  Ann Parks Fine Art reserves the right to refuse service, terminate accounts, remove or edit content or cancel orders at our sole discretion. 

Applicable law

The laws of the State of Texas govern these Terms and Conditions and any disputes that might arise between you and us relating to the use of this website.  Jurisdiction for any dispute relating in any way to your visit to or the use of our website is subject to the jurisdiction of Collin County of the state of Texas.

To the maximum extent allowed by law under no circumstances will Ann Parks Fine Art have any liability to you for direct, indirect, incidental, special, consequential or exemplary damages including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses whether in contract, negligence, tort or otherwise arising out of or in connection with your use of the website, materials or any failure of performance, error, omission, interruption, effect, delay in operation or transmission, computer virus, line system failure, loss of data or loss of use related to the website.  We will not be liable for any damages of any kind arising from the use of the website including but not limited to direct, indirect, incidental, punitive or consequential damages.  Certain laws do not allow limitations as contained in this clause.  If these laws apply, some or all of the above limitations may not apply to you and you might have additional rights.  

Storage of Artwork

Artwork, if stored, must be stored in a climate controlled environment at all times. 

Color of Artwork

Every monitor and printer reads color differently.  If color of artwork is critical to your project success, please contact us for a small strike-off before your order is placed. 

Print on Demand, Cancellation, Exchange and Refund

All artwork is printed, gallery-wrapped and/or framed at your demand, quality inspected before shipment.  Due to the speed of order processing, we do not offer cancellations of orders.  Artwork is not exchangeable or returnable.  We do not stock inventory or pre-printed and framed art and as such, we do not offer returns.

No Warranties

The website and all materials are provided "as is" without any representations or warranties without limitation, implied warranties of merchant-ability and or fitness for a particular purpose. 

Site Modifications & Disclaimer

We reserve the right to make changes to our site, pricing, site access, policies and our terms and conditions at any time and in our sole discretion.  You should review all of these each time you visit our site and your continued use of our site constitutes your binding acceptance of the site.  While we have made every effort to maintain accuracy, Ann Parks Fine Art is not responsible for any errors, omissions or losses from the information contained in our website. 

Risk of Loss

All purchases from Ann Parks Fine Art is made pursuant to a shipping contract.  This means the risk of loss and the title to product purchases passes to you upon our delivery of the product to the shipping carrier.  If your order is placed with a purchase order, the shipping term FOB Ann Parks Fine Art shipping dock will supersede any shipping terms in your purchase order.
